Extrinsic Evidence

  • The parol ( oral ) evidence rule will apply where a document records the terms of a contract . 
  • Under the provision of Evidence Act 1950 , the parol evidence rule excludes the use of oral evidence for the purpose of contradicting , varying , adding to , or subtracting from the langugage of a written document . 
  • The rationale : to preserve a degree of finality in written documents intended to be final .
