Acceptance of the goods

  • The buyer is bound to accept goods and to pay for them in accordance with the terms of the contract . 
  • Under the provision of Section 42 , 'acceptance ' is defined by any of the following situations : 
(i) When the buyer intimates to the seller his acceptance .
(ii) When the goods have been deliveted to the buyer , he does any act which is inconsistent with the ownership of the seller (e.g. reselling to a third party ) or
(iii) When , after the lapse of a reasonable time , the buyer retains the goods without intimating to the seller his rejection .
