Representations

• Representations are statements ( made in the course of negotiation ) which have not been incorporated into the contract . 
• Remedies for untrue represntations - the innocent party may rescind the contract only without the right to claim for damages ( unless fraud is involved ) . In contrast , if there is an untrue term , the innocent party may claim for damages and have the right to terminate the performance of the contract .
