Privity of Contract

  • General rule : Only the parties to a contract can sue and be sued over it , i.e. a contract cannot give rights to , nor impose liabilities on , others. 
  • Example : if x enters into a contract with Y , only X and Y can enforce or sue on the contract . Z , who is not a party to the contract , cannot do so .
