Free consent

  • Free consent is the basis of a contractual relationship 
  • Contracts Act 1950 provides that : 
" All agreements are contracts if they are made by the free consent of parties competent to contract , for a lawful consideration and with a lawful object ,a nd are not hereby expressly declared to be void . " ( Section 10 1) /

"Two or more person are said to consent when they agree upon the same thing in the same sense . ( Section 13 )


  • Consent is said to be free when it is not caused by coercion , undue influence , fraud , musrepresentation or mistake (refer to notes on Lecture 2 ) .
