Express terms

• A terms is express if it has been specifically agreed upon by the parties to a contract . and it may be either oral or in writing or of both . 
• Identification of express terms is by looking at the documents , if any , or at the negotiations conducted by the parties ( to determine which oral statements were intended by the parties to operate as terms ).
